Terms of Service

These Terms of Service (“Terms”) govern your use of the BitMuse application (“Software”) developed by BitMuse (Serhii Maltsev) (“we”, “us”). By downloading or using BitMuse, you agree to these Terms.
1. License
Upon purchase of a valid license, we grant you a personal, non-exclusive, non-transferable license to install and use BitMuse on up to three (3) Mac computers that you own or control. This license is perpetual for the major version purchased.
2. Free Trial
BitMuse offers a free 30-day trial with full functionality. After the trial period, a valid license is required to continue using the Software. No payment information is required to start the trial.
3. Payments
Payments are processed by Lemon Squeezy, which acts as our Merchant of Record. By making a purchase, you also agree to Lemon Squeezy’s Terms of Service. Prices may vary by region and are displayed inclusive of applicable taxes.
4. Ownership
BitMuse and all associated intellectual property remain the property of BitMuse (Serhii Maltsev). You may not copy, modify, distribute, sell, or reverse-engineer the Software, except as permitted by applicable law.
5. Your Content
BitMuse processes music files stored on your computer. You are responsible for ensuring you have the right to use the content in your library. We do not access, store, or transmit your music files.
6. Third-Party Services
BitMuse may integrate with optional third-party services (Last.fm, LRCLIB, MusicBrainz). Your use of these services is subject to their respective terms. We are not responsible for the availability or content provided by third-party services.
7. Disclaimer of Warranties
BitMuse is provided “as is” without warranty of any kind, express or implied. We do not warrant that the Software will be error-free or uninterrupted. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of BitMuse. Our total liability shall not exceed the amount you paid for the Software.
9. Termination
We may terminate your license if you breach these Terms. Upon termination, you must stop using the Software and delete all copies. Sections 4, 7, 8, and 10 survive termination.
10. Governing Law
These Terms are governed by the laws of the European Union and the applicable laws of the developer’s country of residence. Any disputes shall be resolved in the competent courts of that jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of BitMuse after changes constitutes acceptance of the updated Terms.
